General terms of sale and delivery of JOJOBA EUROPE · Version September 2026

1. Who we are and when these terms apply

  1. These terms apply to every offer, order, sample request and delivery of Jojoba Europe, Amersfoortseweg 30-26, 3751 LK Bunschoten, the Netherlands, info@jojobaeurope.eu, +31 (0)6 1842 0421 ("we", "us").
  2. We sell to businesses only. By ordering you confirm that you act in the course of your trade or profession.
  3. Your own purchasing terms do not apply, unless we have accepted them in writing.

2. Prices and offers

  1. All prices are in euros, per kg, and exclude VAT. Shipping costs are shown separately before you order.
  2. For deliveries to businesses in another EU country with a valid VAT number, VAT is reverse charged. For deliveries in the Netherlands, and where no VAT number can be confirmed in the EU VIES register, we charge Dutch VAT.
  3. Offers on the website are without obligation and may change. Obvious mistakes in prices or product information do not bind us.
  4. The 5% first-order discount is a temporary introductory offer. It applies once, to the product total of a customer's first order, and cannot be combined with contract prices. We may end the offer at any time; a discount already saved before that date stays valid for the first order.

3. Orders

  1. To order on invoice you need a business account with a valid VAT number.
  2. An order is binding once we confirm it by email. We may refuse or cancel an order, for example after a credit check, and may ask for partial or full prepayment.
  3. Orders to a new or changed delivery address are shipped after we have checked the address with you.

4. Delivery

  1. We ship from our warehouse in the Netherlands, usually within 1–5 working days. Delivery times are an estimate and not a strict deadline.
  2. Delivery is to the address in your order. Risk passes to you when the goods are delivered at that address.
  3. Please check the goods and packaging on delivery and note any visible damage on the carrier's delivery note.

5. Payment

  1. Payment is due within 30 days of the invoice date, by bank transfer, quoting the invoice number.
  2. If you pay late, you owe the statutory commercial interest (article 6:119a of the Dutch Civil Code) from the due date, plus reasonable collection costs.
  3. The goods remain our property until all amounts you owe us have been paid in full.

6. Quality, documents and complaints

  1. Our products meet the specification (PDS) of the grade ordered. A certificate of analysis (CoA) is sent with every order; you can request it beforehand.
  2. Report visible defects or shortages within 8 days of delivery, and hidden defects within 8 days of discovery and no later than 3 months after delivery, by email with your order number and photos where possible.
  3. Do not use or process goods you have complained about until we have responded. If a complaint is justified, we choose to replace the goods, credit the price, or take the goods back.
  4. Returns are only accepted after written agreement.

7. Use of the products

  1. Our products are cosmetic raw materials. You are responsible for your formulation, product safety assessment, labelling and compliance of your finished products, and for checking that our product is suitable for your application.
  2. Information we give about applications is given in good faith and without warranty.

8. Samples

  1. Samples are free. We charge a fixed shipping cost per sample shipment. A sample request is not an order; we refund this shipping cost on your first product order.
  2. Sample quantities are approximate and are for testing only.

9. Liability

  1. Our liability is limited to the invoice value of the order concerned. We are not liable for indirect or consequential damage, such as lost profit, production stoppage or recall costs.
  2. These limitations do not apply to damage caused by our intent or gross negligence.

10. Force majeure

We are not liable for delays or failure to deliver caused by circumstances beyond our control, such as crop failure, transport disruption, strikes, government measures or failure of our suppliers.

11. Law and disputes

  1. Dutch law applies. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
  2. Disputes are submitted to the competent court in the district of Midden-Nederland, the Netherlands.
